TERMS AND CONDITIONS OF THE PROCEDURE / VIRTUAL SERVICE / VISAS

By opting for our specialized VISA services, either through the "Virtual Service" or face-to-face interactions, you agree to these specific Terms and Conditions, in addition to MIGRALAW's general Terms and Conditions. This document details the process and policies applicable to the handling of your VISA process.

Once our services have been explained and after a feasibility analysis of your process, a quotation will be provided.
Feasibility Analysis
- The assessment of the feasibility of your case can be done through the MIGRALAW feasibility analysis platform, email, voice call, video conference, or WhatsApp. This initial analysis is crucial to understand the specific needs of your case and how we can best assist you.
2. Quotation Authorization and Payment Modalities
For Urgent Services with Promise of Return: Once the quotation is authorized by the client, the payment will be divided in two parts: 50% at the beginning and the remaining 50% once the service has been completed to the client's satisfaction. This modality is designed for services that require expedited handling and promise of appointment date.
For Normal Non-Emergency Visa Processing: In cases that do not require expedited processing or a guarantee of a specific appointment date, 100% payment is required after quote authorization to proceed with standard visa processing. This approach ensures the dedication and resources necessary for the effective processing of your visa application under a regular timeframe.
3. Compilation of Documents
- All documents required for the process must be sent digitally via email or MIGRALAW's platforms. This method ensures an efficient and secure collection of the required documentation and facilitates the process for both the client and our lawyers.
4. Request for Travel Destination Information
- Detailed information about the travel destination and travel plan will be requested in order to properly prepare appointment requests and forms to the consulate or embassy of your choice.
5. Sending of Forms via Digital or Courier
- Upon receipt of the documents, MIGRALAW will send the relevant forms digitally to the client. If necessary, the physical forms will be sent through a courier service.
6. Appointment Management at Consulates and Embassies
- MIGRALAW will assist in arranging the corresponding appointment. It is the responsibility of the user to show up punctually at the time and date indicated for his/her appointment at the consulate or embassy.
7. Communication Channel
- Communication between MIGRALAW and the customer will be carried out exclusively by email, WhatsApp, or MIGRALAW's platforms, facilitating an efficient interaction adapted to the nature of the virtual service.
Important Notes:
- Consular Discretion: MIGRALAW takes all necessary steps under applicable law to facilitate a favorable response in your visa process. However, the final decision on visa issuance rests with the consulate or embassy and cannot be guaranteed by MIGRALAW.
Digital Document Management
- Predominantly Digital Process: Since MIGRALAW's "Virtual Service" service focuses on online processes, most documents will be handled in digital format. Therefore, we generally do not require the possession of original documents.
- Exceptions for Original Documents: Only in extraordinary and specific cases, where strictly necessary, original documents will be requested. In these situations, the best way to handle these documents will be coordinated with the client.
Procedure for Handling Original Documents
- Collection and Return of DocumentsIn cases where original documents are required:
- Pick-up: If it is necessary to pick up original documents, a courier service will be arranged. Details and pick-up time will be communicated in advance.
- Return: Once the paperwork has been submitted, the courier service will be prepared within approximately 10 working days to return the original documents to the client.
- Urgent Courier Costs: If the customer requires the return of documents on an urgent basis, outside of the established delivery time, any additional courier costs will be the responsibility of the customer.
Characteristics of the Virtual Process related to temporality.
- Client-Centered Process: In MIGRALAW's "Virtual Service" service, the timeliness of the processing depends largely on the client. Since the process is virtual, the speed and efficiency of the process is influenced by the promptness and accuracy with which the client responds and provides the necessary information.
Factors Influencing Temporality
- Appointment and Process Management: The organization and scheduling of appointments, as well as the completion of specific processes, are key steps that depend on customer interaction and cooperation.
- Client Resolution: Resolution of paperwork depends on how quickly and efficiently the client can comply with requirements, submit necessary documentation, and respond to requests for additional information.
Customer Responsibilities
- Active and Timely Communication: The client is expected to maintain constant and timely communication through the established channels (email or WhatsApp) to expedite the process.
- Provision of Documentation and Answers: The speed in the provision of required documents and answers to queries will have a direct impact on the total duration of the process.

Availability for Questions and Concerns
To ensure that all clients receive timely and efficient attention, MIGRALAW has established specific office hours. During these hours, the MIGRALAW team will be available to answer all your questions and queries related to the immigration services offered.

Friday:
Hours: From 9:00 am to 2:00 pm.
Usage: During these days and times, you can expect to receive answers to your inquiries, schedule virtual calls or meetings, and receive general advice.

Consultation Planning:
Customers are encouraged to plan their consultations within these hours to ensure a prompt response.
Flexibility: MIGRALAW strives to be flexible and responsive to the needs of its clients, but consideration of these schedules for non-urgent inquiries is appreciated.
After Hours Emergencies:
In case of emergencies that require attention outside these hours, it is advisable to communicate through the designated channel and MIGRALAW will do its best to address the situation in a timely manner.
These hours of operation are designed to maximize efficiency and ensure that all customers receive the attention and support they need in a reasonable time frame.
Withdrawal of the procedure
Conditions: In the "Virtual Lawyer" service, if a client decides to withdraw from the proceeding after having initiated the process.
Refund: No refunds will be made in case of cancellation by the customer.
Delays in Appointment Management or in Processes
Conditions: Since MIGRALAW acts as a principal to perform and support in all the process required by foreign persons to manage their appointment processes, we cannot guarantee times. MIGRALAW will use all its knowledge and resources to achieve favorable results. Therefore, if a client is inconvenienced by the time issue, no refunds will be applied.
Refund: Not applicable.
Denial of Processing
Conditions: If the processing is denied and it is determined that the cause of the denial was the responsibility of MIGRALAW.
Refund: In these cases, a 100% refund of the payment made by the customer will be made.
Cancellation of the Process by the Customer
Conditions: If the client decides to cancel the procedure after having initiated the process.
Refund: No refunds will be made in case of cancellation of the procedure by the client.
Migratory Rights
Conditions: Regarding payments made for immigration fees as part of the procedure.
Refund: There will be no refund of immigration fees under any circumstances.
Return of Promise in Urgent Proceedings
Conditions: In the case of urgent services where a specific promise has been made to obtain an appointment within a specified time frame, and MIGRALAW fails to fulfill this promise due to circumstances within our control.
Reimbursement: A full reimbursement will be offered, as previously agreed with the client, depending on the stages completed in the process and the resources already invested by MIGRALAW at the time of non-compliance.
Returns Procedure
Applicability: Only applicable in the case of a refusal of processing that is the responsibility of MIGRALAW, or in the case of non-fulfillment of a promise in an urgent process.
Process: The customer must follow the procedure established by MIGRALAW to request a refund. The return will be processed according to MIGRALAW's internal policies.
PERSON IN CHARGE OF YOUR PROCEDURE IN THE "VIRTUAL SERVICE" SERVICE
The person chosen by chance, if a direct call with the person in charge is required to attend a special case, it is necessary to contact the customer service area so that a call can be scheduled or channeled.

Customer's Statement of Truthfulness
Honesty Commitment:
By initiating a transaction with MIGRALAW, you, as a client, declare under oath and under the principle of good faith, that all documentation
provided for your transaction has been obtained by legal means and is authentic and valid.
Consequences of False or Invalid Documentation
Cancellation of the Procedure:
In the event that MIGRALAW determines that any document provided by the client is false or that the information lacks validity or veracity, the current immigration procedure will be cancelled.
Customer Responsibility:
It is the customer's responsibility to ensure that all information and documentation provided is truthful and legally obtained.
LIMITATION OF LIABILITY CLAUSE
MIGRALAW shall not be liable for delays, errors or failures to perform caused by events beyond its reasonable control, including, but not limited to, changes in immigration legislation, delays by governmental authorities, or technological failures.
PRIVACY AND CONFIDENTIALITY CLAUSE
MIGRALAW is committed to protecting the privacy and confidentiality of all information and documentation provided by customers, using appropriate security measures to prevent unauthorized access, disclosure, alteration or destruction.

ADAPTATION TO REGULATORY AND DOCUMENTARY CHANGES
Regulatory Changes:
In the dynamic field of immigration law, laws, regulations and requirements may change. MIGRALAW is committed to keeping up to date with these changes. In case of changes in the legal requirements or in the documentation necessary for your immigration process, MIGRALAW will inform the client in a timely manner.
Adjustment of Procedures:
Upon notification of such changes, MIGRALAW will adjust your processing procedure to align with the new requirements. This may include requesting additional documentation, modifying legal strategies, or changing processing times.
CUSTOMER-INITIATED CHANGES
Change Requests by the Client: If the client wishes to change the scope or nature of the processing after the process has been initiated (e.g., changing the type of visa or immigration processes requested or adding dependents), he/she should advise MIGRALAW as soon as possible.
Review of Terms and Conditions: Upon receipt of a change request from the customer, MIGRALAW reserves the right to review and, if necessary, issue new terms and conditions that adequately reflect the scope and requirements of the modified processing.
Acceptance of New Terms:
The client must accept these new terms and conditions in order for MIGRALAW to proceed with the modified processing. This may include adjustments to
fees, deadlines and specific procedures.
COMMITMENT TO CLEAR COMMUNICATION
MIGRALAW is committed to maintaining clear and transparent communication throughout the process of modifying the procedure, ensuring that the client is fully informed and can make decisions based on the most up-to-date information.
Dispute Resolution Process:
- Direct Negotiation: In the event of any dispute, complaint or disagreement arising between the client and MIGRALAW, both parties agree to try to resolve the conflict through direct negotiation, seeking an amicable solution that addresses the concerns of both parties.
- Mediation: If direct negotiation fails to reach a satisfactory resolution, the parties agree to submit to a mediation process, where an impartial mediator will facilitate communication between the parties to find a mutually acceptable solution.
- Arbitration: In the event that both negotiation and mediation do not result in an agreement, the dispute will be taken to arbitration. This process will be conducted by a neutral arbitrator selected in accordance with the rules of a recognized arbitration institution agreed upon by both parties. The arbitrator's decision shall be final, binding and legally enforceable.
Non-Defamation Commitment:
- Conduct Agreement: The client agrees to refrain from making any public statement, on social media or any other medium, that could be considered defamatory, discrediting or damaging to MIGRALAW's reputation. This includes avoiding unfounded negative comments, misleading statements or any form of baseless accusation.
- Internal Handling of Dissatisfaction: Any dissatisfaction or concerns related to services received should be communicated directly to MIGRALAW through official customer service channels. MIGRALAW is committed to addressing and resolving these concerns in a professional and timely manner.
- Legal Consequences: In the event of a breach of the non-defamation pledge, MIGRALAW reserves the right to take legal action necessary to protect its reputation, integrity and legal rights. This may include, but is not limited to, claims for defamation and damages.
Shared Responsibility:
Both parties recognize the importance of maintaining open, respectful and constructive communication throughout the dispute resolution process. MIGRALAW is committed to always act with the utmost integrity and transparency, seeking fair and equitable solutions for all parties involved.
FORCE MAJEURE
MIGRALAW shall not be liable for failure or delay of its obligations under these terms and conditions in case of force majeure events, such as natural disasters, strikes or significant political changes.
WAIVER CLAUSE
Scope of Services:
MIGRALAW is proud to offer professional immigration and VISA legal advisory services in both virtual and in-person modalities. Our team of experts is committed to providing high quality guidance, support and management based on our experience, up-to-date knowledge and current legal practices.
Limitation of Warranties:
- Advisory Nature: The services provided by MIGRALAW, including but not limited to counseling, document preparation, appointment management and representation before authorities, are essentially advisory in nature. MIGRALAW strives to apply its best professional judgment, experience and diligence in all cases.
- No Guarantee of Specific Results: Although MIGRALAW is committed to make every reasonable effort to achieve a favorable outcome, the client acknowledges and accepts that in the legal field, especially in immigration and VISA procedures, specific results cannot be guaranteed. External factors, including decisions of immigration authorities and changes in legislation, may influence the outcome of any proceedings.
- Client Acknowledgement: By engaging the services of MIGRALAW, the client acknowledges and accepts these limitations, understanding that the advice and management provided by MIGRALAW is done with the objective of maximizing the chances of success, but without being able to assure a particular outcome.
Client's Responsibility:
The success of the procedures also depends on the client's cooperation, including the timely provision of complete and accurate information, as well as the delivery of all required documents in the requested forms and deadlines. The client agrees to fulfill these responsibilities to facilitate the process.
Modifications and Regulatory Changes:
MIGRALAW keeps abreast of updates and changes in immigration laws and regulations. However, the client understands that the legal environment is dynamic and that regulatory changes may affect the strategy and outcome of the proceedings initiated. MIGRALAW will not be responsible for the effects of such regulatory changes on ongoing procedures.
Comprehensive Agreement:
This disclaimer is an integral part of the Terms and Conditions of use of MIGRALAW's services and should be read and understood in conjunction with all other provisions set forth in the agreement between MIGRALAW and the customer.
MODIFICATION OF TERMS AND CONDITIONS
MIGRALAW reserves the right to modify these terms and conditions at any time. The modifications will come into force immediately after their publication on the website or their communication to the customer.
JURISDICTION AND APPLICABLE LAW
These terms and conditions are governed by and construed in accordance with the laws of the United Mexican States. Any legal dispute relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in Mexico.
