By opting for MIGRALAW's immigration services, you benefit from personalized and direct legal advice, complemented with the efficient use of digital tools to streamline the immigration processes of your partners, owners or collaborators. The following are the terms and conditions that govern our relationship with legal entities or individuals with business activity:

Receipt of Letters and Presentation of Quotation:

Once we receive your application and initial documentation, our team performs a detailed analysis of the feasibility of your case. Based on this analysis, we will present a customized quote reflecting the services required for your immigration process. This approach ensures that every aspect of your case is carefully considered and discussed in person or through virtual meetings, depending on your preference.

Quote Authorization and Payment.

After presentation and detailed explanation of the quote, we require authorization and payment for the service in order to proceed. This step confirms your commitment to the process and allows us to move forward with the subsequent stages of your process with the assurance that all financial aspects are clear and agreed upon.

MIGRALAW offers three payment options to suit the needs of our business clients:

50% payment option at the beginning and 50% prior to the conclusion of the process.

This option requires
:

-Requires payment of 50% of the initial fee along with 100% of the immigration fees.
-The remaining 50% of the fee is paid upon completion of the process.

This option is aimed at clients who are hiring us for the first time or sporadically.

100% upon issuance of the invoice:

For recurring clients, 100% payment of the fees is requested at the time of issuing the invoice.

This modality facilitates a more agile billing and payment process for those with an established and constant relationship with MIGRALAW.

30, 60 or 90 Days Credit:

We offer a credit option with terms of 30, 60 or 90 days.

-It is important to note that immigration fees are not subject to credit and must be paid in full at the time of immigration.

-A signed contract per year is required and a credit initiation fee of $1,500 USD for 30 days, $2,000 USD for 60 days or $2,500 USD for 90 days of credit.

This fee will be taken on account of the company's initial processing.

-This option is available to customers with a favorable credit rating and who are looking for flexibility in their payments.

These payment options are designed to provide flexibility and convenience, ensuring that our customers can choose the modality that best suits their needs and financial capabilities.

Collection of Documents via E-mail:

To maximize the efficiency and security of the process, we request that all necessary documents are sent digitally to legal@migralaw.org. This practice not only facilitates the collection and review of documents but also speeds up the process, allowing for a more agile handling of your case.

Sending of Forms via Digital or Courier:

Once the documentation has been reviewed and completed, MIGRALAW will prepare and send the relevant forms and documents required for processing. Although the process is face-to-face, we use digital means to send you relevant documentation, ensuring speed and efficiency. In situations where physical forms are required, these will be delivered personally or sent by courier service, as needed.

Exclusively Digital Communication Channel:

Although our service is face-to-face, continuous communication between MIGRALAW and you will be facilitated through digital means such as email or WhatsApp. This modality ensures effective and direct communication, allowing us to keep you informed about the progress of your procedure and respond quickly to any queries or needs that may arise during the process.

 Digital Document Management

  • Predominantly Digital Process: Since MIGRALAW's "Virtual Lawyer" service focuses on online processes, most documents will be handled in digital format. Therefore, we generally do not require the possession of original documents.
  • Exceptions for Original Documents: Only in extraordinary and specific cases, where strictly necessary, original documents will be requested. In these situations, the best way to handle these documents will be coordinated with the client.

Procedure for Handling Original Documents

  • Integration of Digital and Face-to-Face Processes: Although the service offered by MIGRALAW is face-to-face, we incorporate digital processes to maximize efficiency and convenience for our clients. This allows an agile management of documents and facilitates communication during the process.

    Collection of Documents in Digital Format:

    • Digitalization Preferred: To expedite the process, we ask clients to send documents in digital format via email to legal@migralaw.org whenever possible. This includes forms, IDs, and any other documents relevant to the process.
    • Digitization Support: For clients requiring assistance in digitizing documents, MIGRALAW will provide guidance on how to proceed effectively and securely.

    Handling of Original Documents:

    • Specific Situations: We understand that certain procedures may require the presentation of original documents. In these cases, we will coordinate with the client to determine the best method of delivery, either in person during face-to-face appointments or through a reliable courier service.
    • Security Procedures: To ensure the security of the original documents, we establish clear handling procedures, including verification of documents upon receipt and delivery back to the client.

    Courier Service for Original Documents:

    • Secure Pickup and Return: When it is necessary to use original documents, we will arrange pickup and return through a courier service, communicating details and timing in advance.
    • Courier Costs: MIGRALAW will cover standard courier costs for the collection and return of original documents. In cases where an urgent return is required outside of the standard timeframe, additional costs will be the responsibility of the client.

  • Although MIGRALAW offers a face-to-face service for the processing of PERSONAL MIGRATION PROCEDURES, the integration of digital tools plays a crucial role in optimizing the timeliness of the process. This combination allows a more efficient and personalized management of the process, adapting to the specific needs of each client.

    Factors Influencing Temporality:

    1. Appointment and Process Management: The organization and scheduling of face-to-face appointments, as well as the preparation for specific processes, are critical and require active collaboration between MIGRALAW and the client. The client's availability to attend face-to-face appointments and meetings is essential to maintain the flow of the process.

    2. Digital Complement to Efficiency: The use of digital services for the collection of information and documents significantly accelerates the preliminary stages of the process. The efficiency of the process is influenced by the speed with which the customer responds to digital requests and provides the necessary documentation accurately.

    Client's Responsibilities:

    1. Active and Timely Communication: The client is expected to maintain a fluid and timely communication, not only through digital channels such as email or WhatsApp, but also in the coordination and attendance to face-to-face appointments. This two-way communication is vital for the progress of the process.

    2. Provision of Documentation: Although the process benefits from digitization for certain aspects, the delivery of physical documents when necessary, and the prompt completion and delivery of specific forms and requirements, are crucial to the progress and success of the process.

  • Migratory Fees and Other Payments: Payments made for migratory fees or to governmental entities are not reimbursable by MIGRALAW.

Honesty Commitment: By initiating a transaction with MIGRALAW, you, as a client, declare under oath and under the principle of good faith, that all documentation provided for your transaction has been obtained by legal means and is authentic and valid.

Consequences of False or Invalid Documentation

Cancellation of the Procedure: In the event that MIGRALAW determines that any document provided by the client is false or that the information lacks validity or veracity, the current immigration procedure will be cancelled.

Customer Responsibility: It is the customer's responsibility to ensure that all information and documentation provided is truthful and legally obtained.

LIMITATION OF LIABILITY CLAUSE

MIGRALAW shall not be liable for delays, errors or failures to perform caused by events beyond its reasonable control, including, but not limited to, changes in immigration legislation, delays by governmental authorities, or technological failures.

PRIVACY AND CONFIDENTIALITY CLAUSE

MIGRALAW is committed to protecting the privacy and confidentiality of all information and documentation provided by customers, using appropriate security measures to prevent unauthorized access, disclosure, alteration or destruction.

ADAPTATION TO REGULATORY AND DOCUMENTARY CHANGES

Regulatory Changes: In the dynamic field of immigration law, laws, regulations and requirements may change. MIGRALAW is committed to keeping up to date with these modifications. Review of Terms and Conditions: Upon receipt of a change request from the customer, MIGRALAW reserves the right to review and, if necessary, issue new terms and conditions that adequately reflect the scope and requirements of the modified processing.

Acceptance of New Terms: The client must accept these new terms and conditions in order for MIGRALAW to proceed with the modified processing. This may include adjustments to fees, deadlines and specific procedures.

COMMITMENT TO CLEAR COMMUNICATION

MIGRALAW is committed to maintaining clear and transparent communication throughout the process of modifying the procedure, ensuring that the client is fully informed and can make decisions based on the most up-to-date information.

DISPUTE RESOLUTION AND REPUTATION PROTECTION

Negotiation and Mediation: Should a dispute, complaint or disagreement arise between the client and MIGRALAW related to the services provided, both parties first undertake to seek a solution through a structured negotiation process. If this approach does not satisfactorily resolve the dispute, mediation will be undertaken.

Arbitration: If negotiation and mediation fail to resolve the dispute, the conflict will be submitted to arbitration. Decisions made through this process will be final and binding on both parties.

PRIVACY AND CONFIDENTIALITY CLAUSE

MIGRALAW guarantees its commitment to protect the privacy and confidentiality of all information and documentation provided by customers. Appropriate security measures will be implemented to prevent any form of unauthorized access, disclosure, alteration or destruction of personal information. Similarly, the client is expected to respect and maintain the confidentiality of the information to which he/she has access during the provision of our services. This obligation of confidentiality extends to all content available on our websites.

DISPUTE RESOLUTION AND REPUTATION PROTECTION

In the event of any dispute, complaint or disagreement arising between the customer and MIGRALAW in connection with the services offered, both parties undertake to attempt to resolve the situation through a structured process of negotiation and, if necessary, mediation. If these efforts are not satisfactory, the dispute shall be resolved through arbitration, whose decisions shall be final and binding on both parties.

COMMITMENT NOT TO DEFAME

The Client undertakes to refrain from making any kind of public statement, on social networks or any other media, that may be considered defamatory, discrediting or damaging to the moral and professional reputation of MIGRALAW. This obligation includes avoiding the dissemination of defamatory comments, misleading statements or unfounded accusations. Any dissatisfaction or concern is expected to be communicated directly to MIGRALAW through official communication channels.

Consequences of Defamation and Breach of Confidentiality: In the event of breach of the non-defamation undertaking or breach of the confidentiality obligation, MIGRALAW reserves the right to take legal action to safeguard your reputation and rights. In addition, any immigration proceedings or return process may be suspended until a satisfactory agreement is reached. It will be necessary to sign a letter of undertaking not to defame and confidentiality, both before and after the return process. The return process will only continue once this letter has been signed, studied and received.

FORCE MAJEURE

MIGRALAW shall not be liable for failure or delay of its obligations under these terms and conditions in case of force majeure events, such as natural disasters, strikes or significant political changes.

External factors, including decisions of immigration authorities and changes in legislation, may influence the outcome of any proceedings.

Client Acknowledgement: By engaging the services of MIGRALAW, the client acknowledges and accepts these limitations, understanding that the advice and management provided by MIGRALAW is done with the objective of maximizing the chances of success, but without being able to assure a particular outcome.

Client's Responsibility:

The success of the procedures also depends on the client's cooperation, including the timely provision of complete and accurate information, as well as the delivery of all required documents in the requested forms and deadlines. The client agrees to fulfill these responsibilities to facilitate the process.

Modifications and Regulatory Changes:

MIGRALAW keeps abreast of updates and changes in immigration laws and regulations. However, the client understands that the legal environment is dynamic and that regulatory changes may affect the strategy and outcome of the proceedings initiated. MIGRALAW will not be responsible for the effects of such regulatory changes on ongoing procedures.

Comprehensive Agreement:

This disclaimer is an integral part of the Terms and Conditions of use of MIGRALAW's services and should be read and understood in conjunction with all other provisions set forth in the agreement between MIGRALAW and the customer.
